TERMS AND CONDITIONS OF THE FANTASMATIC.PL ONLINE STORE<\/h1>\n

\u00a71. General Provisions<\/h2>\n

  1. The Fantasmatic.pl online store, available at www.fantasmatic.pl<\/strong><\/a>, is operated by FANTASMATIC SP. Z O.O.<\/strong>, with its registered office at Al. Solidarno\u015bci 113, unit 21A, 00-140 Warsaw, Poland, entered in the National Court Register under KRS No. 0000876396, NIP 5252848100, REGON 387878100, hereinafter referred to as the \u201cSeller\u201d.<\/li>\n
  2. These Terms and Conditions set out the rules for using the Store, placing and paying for Orders, booking appointments, and concluding and performing contracts concerning Services and Products offered by the Seller.<\/li>\n
  3. These Terms and Conditions apply to both Consumers and Business Customers, subject to mandatory provisions granting particular protection to Consumers and to natural persons conducting business activity who, under applicable law, are entitled to certain consumer rights.<\/li>\n
  4. Placing an Order requires the Customer to read and accept these Terms and Conditions.<\/li>\n
  5. Before placing an Order, the Customer also confirms that they have read the Seller\u2019s Privacy Policy.<\/li>\n<\/ol>\n

    \u00a72. Definitions<\/h2>\n
      \n
    1. Seller<\/strong> \u2013 FANTASMATIC SP. Z O.O.<\/li>\n
    2. Store<\/strong> \u2013 the online store operating at www.fantasmatic.pl<\/a>.<\/li>\n
    3. Customer<\/strong> \u2013 a natural person, legal person or organisational unit placing an Order through the Store.<\/li>\n
    4. Consumer<\/strong> \u2013 a natural person entering into a legal transaction with a business which is not directly related to their trade, business or profession.<\/li>\n
    5. Service<\/strong> \u2013 a photographic service or another service offered by the Seller through the Store, including in particular a photography session together with any selected Additional Services.<\/li>\n
    6. Additional Service<\/strong> \u2013 an additional service connected with the main Service, including in particular make-up services.<\/li>\n
    7. Product<\/strong> \u2013 a product available in the Store, including in particular a Voucher or another product specified in the Store.<\/li>\n
    8. Voucher<\/strong> \u2013 a personalised electronic document, or a printed document upon special request, entitling the person named on the Voucher either to receive a specified Service or to use a specified monetary value towards Services provided by the Seller.<\/li>\n
    9. Order<\/strong> \u2013 a declaration made by the Customer using the Store\u2019s order form with the intention of entering into a Contract with the Seller.<\/li>\n
    10. Booking<\/strong> \u2013 the reservation of a specific date and time for performance of a Service.<\/li>\n
    11. Contract<\/strong> \u2013 a contract concluded between the Seller and the Customer through the Store, the subject of which may include the provision of a Service or the sale of a Product.<\/li>\n<\/ol>\n

            \u00a74. Technical Requirements<\/h2>\n
              \n
            1. In order to use the Store, the Customer must have:
              \na) a device with Internet access,
              \nb) an up-to-date web browser,
              \nc) an active e-mail address,
              \nd) access to one of the payment methods available in the Store.<\/li>\n
            2. Use of the Store does not require registration of a user account unless otherwise indicated for a specific Store function.<\/li>\n
            3. The Customer must use the Store in accordance with applicable law and generally accepted standards of conduct.<\/li>\n<\/ol>\n
              \n
              \n<\/div>\n

              \u00a75. Offers and Prices<\/h2>\n
                \n
              1. Prices displayed in the Store are stated in Polish zloty and include applicable taxes.<\/li>\n
              2. Before placing an Order, the Customer is informed of the total price of the ordered Service or Product, including the price of any Additional Services and any other applicable charges.<\/li>\n
              3. The price applicable to the Customer is the price displayed at the time the Order is placed.<\/li>\n
              4. The scope of individual Services, number of photographs, duration of a photography session, scope of retouching, method of delivery and other elements of the Service are specified in the description of the relevant offer in the Store.<\/li>\n
              5. The duration stated for a photography session may refer solely to the photographic part of the Service. Selection of an Additional Service, particularly make-up, may extend the total duration of the Customer\u2019s appointment.<\/li>\n<\/ol>\n

                \n<\/div>\n

                \u00a76. Placing and Paying for Orders<\/h2>\n
                  \n
                1. Orders may be placed through the Store 24 hours a day.<\/li>\n
                2. In order to order a Service, the Customer:
                  \na) selects the relevant Service or package,
                  \nb) selects any Additional Services,
                  \nc) selects an available appointment where a Booking is required,
                  \nd) provides the information necessary to fulfil the Order,
                  \ne) accepts these Terms and Conditions,
                  \nf) confirms that they have read the Privacy Policy,
                  \ng) makes payment.<\/li>\n
                3. All Orders placed through the Store require full payment in advance.<\/li>\n
                4. A paid Order is submitted using a button labelled \u201cOrder and Pay\u201d or another button clearly indicating that placing the Order entails an obligation to pay.<\/li>\n
                5. Payment for an Order may be made:
                  \na) using the electronic payment methods available in the Store and processed by Blue Media S.A.<\/strong>,
                  \nb) by bank transfer to the Seller\u2019s bank account maintained by mBank S.A.<\/strong>, where such a payment method is available for the relevant Order.<\/li>\n
                6. Card payments made outside the Store, including payments made in person using a payment terminal, do not constitute a payment method for Orders placed through the Store unless expressly agreed otherwise between the Seller and the Customer.<\/li>\n
                7. A Booking becomes effective once the full amount due for the Order has been settled, including where a Voucher or another means of settlement covers the full amount due.<\/li>\n
                8. Failure to settle the full amount due means that the appointment has not been finally booked.<\/li>\n
                9. Following successful placement and payment of an Order, the Customer receives confirmation at the e-mail address provided.<\/li>\n<\/ol>\n
                  \n
                  \n<\/div>\n

                  \u00a77. Booking an Appointment<\/h2>\n
                    \n
                  1. Where a Service is performed at a specific date and time, the Customer selects one of the appointments available through the Store\u2019s booking system.<\/li>\n
                  2. The selected appointment becomes part of the Order.<\/li>\n
                  3. A Booking becomes effective when the requirements set out in \u00a76 have been met.<\/li>\n
                  4. The time shown in the Booking is the time at which the Customer should arrive at the place where the Service is to be performed.<\/li>\n
                  5. Where make-up has been selected as an Additional Service to a photography session, the Customer should arrive at the time shown in the Booking.<\/li>\n
                  6. A Customer who has selected make-up is not required to arrive before the appointment time shown in the Booking.<\/li>\n
                  7. Make-up is performed after the booked appointment begins and extends the Customer\u2019s total appointment time accordingly.<\/li>\n
                  8. Any technical extension made by the Seller to the duration of a Booking in the booking system or calendar due to an Additional Service does not change the starting time communicated to the Customer.<\/li>\n
                  9. The photography-session duration indicated for a particular package may therefore differ from the Customer\u2019s total time at the studio where Additional Services have been selected.<\/li>\n<\/ol>\n
                    \n
                    \n<\/div>\n

                    \u00a78. Punctuality and Performance of the Service<\/h2>\n
                      \n
                    1. The Customer should arrive on time for the Service.<\/li>\n
                    2. A Customer\u2019s late arrival does not automatically postpone subsequent Bookings or extend the time allocated to the Service.<\/li>\n
                    3. Where a Customer\u2019s late arrival makes it impossible to perform the full Service within the scheduled period without affecting subsequent Bookings, the duration of the Service may be reduced accordingly.<\/li>\n
                    4. Where performance of the Service at the agreed time becomes impossible for reasons attributable to the Seller, the Seller will offer the Customer another available appointment or refund the amount paid.<\/li>\n
                    5. Rescheduling for reasons attributable to the Seller will not result in additional costs for the Customer.<\/li>\n<\/ol>\n
                      \n
                      \n<\/div>\n

                      \u00a79. Rescheduling, Cancellation and Failure to Attend<\/h2>\n
                        \n
                      1. The Customer may request that a Booking be rescheduled or cancelled.<\/li>\n
                      2. This section governs voluntary rescheduling and cancellation and does not restrict a Consumer\u2019s statutory right of withdrawal referred to in \u00a711.<\/li>\n
                      3. After expiry of the statutory withdrawal period, or where the right of withdrawal does not apply or has expired, the following rules apply:\n

                        a) where the Booking is cancelled more than 72 hours before the Service is due to begin, the Customer may select another available appointment or receive a refund of the amount paid;<\/p>\n

                        b) where the Booking is cancelled between 24 and 72 hours before the Service is due to begin, the Customer is entitled to a refund of 50% of the amount paid;<\/p>\n

                        c) where the Booking is cancelled less than 24 hours before the Service is due to begin, the amount paid is non-refundable.<\/li>\n

                      4. Failure to attend the Service without prior cancellation is treated in the same way as a cancellation made less than 24 hours before the Service is due to begin.<\/li>\n
                      5. With the Seller\u2019s agreement, the Customer may reschedule the appointment instead of receiving a refund.<\/li>\n
                      6. Refunds are generally made using the same payment method used by the Customer unless the Customer expressly agrees to another method which does not involve any additional cost.<\/li>\n<\/ol>\n
                        \n
                        \n<\/div>\n

                        \u00a710. Performance and Delivery of Materials<\/h2>\n
                          \n
                        1. The scope of materials supplied to the Customer, the method of delivery and the anticipated completion time are specified in the description of the ordered Service.<\/li>\n
                        2. Where the Service requires the Customer to select photographs, further performance of the Service may depend on the Customer making that selection.<\/li>\n
                        3. Any completion period dependent upon an action by the Customer, including the period for retouching following selection of photographs, begins when the Customer performs the required action.<\/li>\n
                        4. The Seller archives the final photographic material covered by the Order for a period of three months following its delivery to the Customer.<\/li>\n
                        5. After the archive period has expired, the Seller does not guarantee that the materials can be supplied again.<\/li>\n<\/ol>\n
                          \n
                          \n<\/div>\n

                          \u00a711. Consumer Right of Withdrawal<\/h2>\n
                            \n
                          1. A Consumer who concludes a distance Contract generally has the right to withdraw from it without giving any reason within 14 days from the date on which the Contract was concluded, subject to statutory exceptions.<\/li>\n
                          2. The withdrawal period is observed if the Consumer sends their withdrawal statement before the expiry of the applicable period.<\/li>\n
                          3. A withdrawal statement may in particular be submitted to the Seller by e-mail.<\/li>\n
                          4. The Consumer may use the statutory model withdrawal form, but is not required to do so.<\/li>\n
                          5. Where a Consumer wishes the Seller to begin performing the Service before expiry of the 14-day withdrawal period, the Consumer must expressly request that performance begin in accordance with the selected appointment.<\/li>\n
                          6. For this purpose, the Store may require the Consumer to select a separate checkbox containing wording substantially equivalent to:<\/li>\n<\/ol>\n

                            \u201cI request that performance of the ordered service begin on the selected appointment date, including where that date falls before the expiry of 14 days from conclusion of the contract. I acknowledge that once the service has been fully performed, I will lose my right to withdraw from the contract.\u201d<\/p>\n

                              \n
                            1. The Consumer acknowledges that after the Service has been fully performed, where performance began with the Consumer\u2019s express prior request and after the Consumer had been informed of the consequences, the right of withdrawal expires in accordance with applicable law.<\/li>\n
                            2. Where performance of the Service has begun at the Consumer\u2019s express request before expiry of the withdrawal period and the Consumer validly withdraws before the Service has been fully performed, the Consumer may be required to pay for the part of the Service performed prior to withdrawal to the extent permitted by applicable law.<\/li>\n
                            3. The voluntary cancellation provisions do not restrict rights granted to Consumers under mandatory provisions of law.<\/li>\n
                            4. Where a Consumer validly withdraws from the Contract, the Seller refunds the amounts due within the period required by law, generally using the same payment method used by the Consumer, unless the Consumer expressly agrees to another method which does not result in additional cost.<\/li>\n<\/ol>\n
                              \n
                              \n<\/div>\n

                              \u00a712. Vouchers<\/h2>\n
                                \n
                              1. The Seller offers:
                                \na) Vouchers entitling the holder to a specific Service identified on the Voucher,
                                \nb) Vouchers with a specified monetary value which can be used towards Services provided by the Seller.<\/li>\n
                              2. A Voucher is valid for 12 months from the date of purchase<\/strong>, unless a different starting date for the validity period is expressly stated on the Voucher.<\/li>\n
                              3. A Voucher expires once its validity period has elapsed.<\/li>\n
                              4. The validity period of a Voucher cannot be extended.<\/li>\n
                              5. A Voucher is personalised.<\/li>\n
                              6. A Voucher may be used only by the person named on the Voucher.<\/li>\n
                              7. A Voucher may not be transferred, resold or given to another person for use.<\/li>\n
                              8. Where a Voucher is issued for a specific Service, a subsequent change in the price of that Service does not affect the holder\u2019s entitlement to receive it.<\/li>\n
                              9. The person entitled under such a Voucher may receive the Service specified on the Voucher without being required to pay an additional amount resulting solely from an increase in the price of that Service after the Voucher was purchased.<\/li>\n
                              10. Where a Voucher has a monetary value, the prices applicable on the date the Booking is made apply when the Voucher is redeemed.<\/li>\n
                              11. Where the price of the selected Service exceeds the monetary value of the Voucher, the person redeeming the Voucher must pay the difference.<\/li>\n
                              12. Where the price of the selected Service is lower than the monetary value of the Voucher, the unused value is not refundable and cannot be exchanged for cash.<\/li>\n
                              13. With the Seller\u2019s agreement, the unused portion of the Voucher value may be applied to Additional Services or other services offered by the Seller in connection with redemption of the Voucher.<\/li>\n
                              14. An appointment for a Service covered by a Voucher may be booked:
                                \na) by telephone,
                                \nb) by e-mail,
                                \nc) through the booking system available in the Store by entering the Voucher\u2019s unique code in the relevant field on the cart or checkout page.<\/li>\n
                              15. Possession of a Voucher does not itself constitute a Booking for a particular appointment.<\/li>\n
                              16. Availability of appointments depends on the Seller\u2019s current calendar availability.<\/li>\n
                              17. A Booking using a Voucher must be successfully made during the Voucher\u2019s validity period.<\/strong><\/li>\n
                              18. The Service itself may be performed after the Voucher\u2019s validity period has expired, provided that the Booking was successfully made before the Voucher expired.<\/li>\n
                              19. A Voucher is normally delivered electronically to the e-mail address provided when it is purchased.<\/li>\n
                              20. At the purchaser\u2019s individual request, the Voucher may also be prepared in printed form.<\/li>\n
                              21. Where preparation or delivery of a printed Voucher involves an additional charge, the purchaser will be informed before that charge is incurred.<\/li>\n
                              22. A Voucher cannot be exchanged for cash, subject to a Consumer\u2019s statutory right of withdrawal and any other rights arising under mandatory law.<\/li>\n
                              23. A Consumer who purchases a Voucher at a distance may withdraw from the Voucher purchase within 14 days in accordance with \u00a711, subject to applicable statutory exceptions.<\/li>\n
                              24. Where the Consumer validly withdraws from the Voucher purchase, the Voucher is cancelled and cannot subsequently be redeemed.<\/li>\n
                              25. Where, before expiry of the withdrawal period, the Voucher has been used to make a Booking and performance of the Service has begun at the Consumer\u2019s express request, the relevant provisions of \u00a711 apply.<\/li>\n<\/ol>\n
                                \n
                                \n<\/div>\n

                                \u00a713. Complaints<\/h2>\n
                                  \n
                                1. The Seller is required to perform the Contract in accordance with its terms and applicable law.<\/li>\n
                                2. A complaint may be submitted:
                                  \na) by e-mail to info@fantasmatic.pl<\/a>,
                                  \nb) in writing to the Seller\u2019s postal address.<\/li>\n
                                3. Where possible, the complaint should include:
                                  \na) the Customer\u2019s details,
                                  \nb) information enabling identification of the Order,
                                  \nc) a description of the issue,
                                  \nd) the Customer\u2019s requested remedy.<\/li>\n
                                4. Where a complaint concerns specific photographs, identifying the relevant filenames or numbers may assist in processing the complaint; however, failure to do so does not deprive a Consumer of the right to make a complaint.<\/li>\n
                                5. The Seller responds to a Consumer complaint within 14 days after receiving it unless mandatory law provides for a different period.<\/li>\n
                                6. Failure to make a complaint within a period specified by the Seller does not result in the loss of a Consumer\u2019s statutory rights.<\/li>\n
                                7. Nothing in these Terms and Conditions limits rights granted to the Customer under mandatory provisions of law.<\/li>\n<\/ol>\n
                                  \n
                                  \n<\/div>\n

                                  \u00a714. Personal Data<\/h2>\n
                                    \n
                                  1. The controller of Customers\u2019 personal data is FANTASMATIC SP. Z O.O.<\/li>\n
                                  2. Customers\u2019 personal data is processed in particular for:
                                    \na) entering into and performing Contracts,
                                    \nb) administering Bookings,
                                    \nc) processing payments,
                                    \nd) issuing accounting and tax documents,
                                    \ne) handling complaints,
                                    \nf) complying with legal obligations applicable to the Seller.<\/li>\n
                                  3. Detailed information concerning personal-data processing, legal bases, retention periods, recipients of personal data and the rights of data subjects is contained in the Privacy Policy available through the Store.<\/li>\n
                                  4. Providing personal data required for an Order is voluntary, but failure to provide such data may make it impossible to conclude or perform the Contract.<\/li>\n
                                  5. Acceptance of these Terms and Conditions does not constitute consent to all forms of personal-data processing. Personal data is processed on the relevant legal bases described in the Privacy Policy.<\/li>\n<\/ol>\n
                                    \n
                                    \n<\/div>\n

                                    \u00a715. Alternative Dispute Resolution<\/h2>\n
                                      \n
                                    1. Consumers may use out-of-court complaint handling and dispute resolution procedures in accordance with applicable law.<\/li>\n
                                    2. Information concerning available alternative dispute resolution procedures may be obtained in particular:
                                      \na) from the Polish Office of Competition and Consumer Protection (UOKiK),
                                      \nb) from municipal and district consumer ombudsmen,
                                      \nc) from other bodies authorised to conduct consumer alternative dispute resolution proceedings.<\/li>\n
                                    3. Information concerning available consumer alternative dispute resolution procedures and ADR bodies operating in European Union Member States is also available through the European Commission\u2019s Consumer Redress in the EU<\/strong> portal.<\/li>\n<\/ol>\n
                                      \n
                                      \n<\/div>\n

                                      \u00a716. Final Provisions<\/h2>\n
                                        \n
                                      1. Contracts entered into through the Polish version of the Store are concluded in Polish unless otherwise expressly agreed.<\/li>\n
                                      2. These Terms and Conditions are available free of charge through the Store in a form that allows them to be saved and reproduced.<\/li>\n
                                      3. Matters not regulated by these Terms and Conditions are governed by applicable Polish law, including in particular the Polish Civil Code and the Polish Consumer Rights Act.<\/li>\n
                                      4. Nothing in these Terms and Conditions excludes or restricts any rights granted to Consumers under mandatory provisions of law.<\/li>\n
                                      5. If any provision of these Terms and Conditions is held to be invalid or unenforceable, this does not affect the validity of the remaining provisions.<\/li>\n
                                      6. The Seller may amend these Terms and Conditions for important reasons, including in particular:
                                        \na) amendments to applicable law,
                                        \nb) changes to the way the Store operates,
                                        \nc) changes to available payment methods,
                                        \nd) changes to the Booking process,
                                        \ne) changes to the scope or manner in which Services are provided.<\/li>\n
                                      7. An amendment to these Terms and Conditions does not affect rights already acquired by Customers or Orders entered into before the amended Terms and Conditions take effect.<\/li>\n
                                      8. These Terms and Conditions take effect on 07.05.2019 r.<\/li>\n
